Introduction
1.1 These Terms of Service ("Terms") govern your use of the TeachX Platform and Services. By accessing or using the TeachX Platform, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the TeachX Platform.
1.2 The TeachX Platform is owned and operated by Teach Platforms FZCO, a corporation registered in Dubai, UAE. Our contact details are set out on the Website.
General Information
2.1 You may use the TeachX Platform as: (i) a registered user seeking tutoring services ("Student"), or (ii) a visitor. TeachX provides access to the TeachX Platform to connect Students with Tutors for in-person, recorded and online tutoring, courses or events services. TeachX does not provide tutoring, courses, or events services directly.
2.2 By creating an account on the TeachX Platform, you agree to provide accurate, complete, and updated information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2.3 TeachX reserves the right to amend these Terms at any time. Changes will be posted on the Website, and by continuing to use the TeachX Platform after such changes, you agree to be bound by the amended Terms.
Student Responsibilities
3.1 Students must be at least 18 years old to book a Tutor, Course or Event for themselves. Students under the age of 18 must have a parent or legal guardian who agrees to these Terms and consents to the Student receiving the services offered on the platform.
3.2 Students must ensure that all personal details and contact information are accurate and up-to-date. TeachX will communicate primarily through email and the TeachX Platform.
3.3 Students are responsible for ensuring that they have the correct equipment to be able to access the Online Classroom prior to an Online Lesson. No refunds will be made in the event that Students are unable to access the Online Classroom for whatever reason, save where such inability to access the Online Classroom arises as a result of TeachX failing to provide the services outlined in clause 4.2 of these terms and conditions.
3.4 Students agree to not use any means to record lessons separately from the TeachX Platform. This includes storing or sharing them.
3.5 Students must provide valid payment details and ensure sufficient funds are available for the payment of tutoring services. By confirming a booking, Students authorize TeachX to process payments for the services.
3.6 Students must not engage directly with Tutors outside the TeachX Platform. All communications should be conducted through the TeachX Platform to ensure safety and compliance with these Terms.
3.7 Students may cancel bookings according to the cancellation policy outlined in the Refund and Payment Policy. Cancellations made within 24 hours of the scheduled lesson may incur a fee. Refunds are processed in accordance with the Refund and Payment Policy.
3.8 Students must ensure a safe environment for in-person tutoring sessions. TeachX is not responsible for any disputes or issues arising from in-person sessions. Students should exercise caution and good judgment when engaging in in-person tutoring.
TeachX Responsibilities
4.1 TeachX will endeavor to maintain the TeachX Platform and keep it free from viruses and other harmful components. However, uninterrupted or error-free availability cannot be guaranteed.
4.2 TeachX may verify the identity and qualifications of Tutors. However, TeachX does not guarantee the accuracy, completeness, or reliability of any Tutor information. Students should independently verify Tutor credentials.
4.3 TeachX will communicate with Students via email and the TeachX Platform regarding bookings, cancellations, and other relevant information. Students are responsible for keeping their email address updated.
Content Policy
5.1 Students are responsible for the content they post on the TeachX Platform, including messages and reviews. Students must not post defamatory, offensive, or illegal content.
5.2 TeachX reserves the right to monitor and remove any content that violates these Terms or is deemed inappropriate.
6.1 By submitting content to the TeachX Platform, Students grant TeachX a non-exclusive, royalty-free, perpetual license to use, modify, and distribute such content.
Dispute Resolution
7.1 TeachX is not responsible for resolving disputes between Students and Tutors. Students and Tutors should attempt to resolve any disputes directly.
7.2 Any dispute arising out of these Terms shall be resolved through binding arbitration conducted in Bahrain under the rules of the American Arbitration Association.
8.1 These Terms shall be governed by and construed in accordance with the laws of Bahrain, without regard to its conflict of law principles.
9.1 For any questions about these Terms, please contact us at [Contact Email].
Privacy Policy
10.1 TeachX respects your privacy and is committed to protecting your personal data. Please refer to our Privacy Policy for information on how we collect, use, and disclose your personal information.
Termination
11.1 TeachX reserves the right to terminate or suspend your account at any time if you violate these Terms or engage in any conduct that TeachX, in its sole discretion, believes is harmful to the TeachX Platform or other users.
11.2 You may terminate your account at any time by following the instructions on the TeachX Platform. Upon termination, you will lose access to the TeachX Platform and any content or data associated with your account.
Liability
12.1 You agree to indemnify, defend, and hold harmless TeachX, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the TeachX Platform or your violation of these Terms.
13.1 To the fullest extent permitted by law, TeachX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the TeachX Platform; (b) any conduct or content of any third party on the TeachX Platform; (c) any content obtained from the TeachX Platform; and (d) unauthorized access, use, or alteration of your transmissions or content.
Complaints
14.1 A "Complaint" covers any cause for the Student to seek a refund as a result of the service provided by the Tutor, including, but not limited to, a Missed Lesson (where the Tutor did not attend a Lesson booked on the Website) or a claim about quality (where the Student feels that the service provided by a Tutor falls below the standards they reasonably expected).
14.2 A Student should inform TeachX of a Complaint within 96 hours after the scheduled finish time of the relevant Lesson.
14.3 Should a Student and Tutor not reach an amicable agreement regarding a complaint, the Student is entitled to make a claim against the Tutor in relation to the complaint. TeachX accepts no liability in relation to complaints and the services provided by a Tutor.
Satisfaction Guarantee
15.1 To reflect TeachX’s confidence in the matching service provided, TeachX will, as a gesture of goodwill, pay a Student who qualifies for the 100% satisfaction guarantee an amount equal to the lesser of the cost of the Initial Lesson or the cost of the Replacement Lesson up to a maximum of $100.
15.2 To qualify for this satisfaction guarantee, the Student must notify TeachX that they are unhappy with their first Lesson within 48 hours of the Lesson’s scheduled finish time, giving their reasons for their dissatisfaction. They must independently find a new, replacement Tutor, with whom they must book, confirm, take, and pay for a Lesson on the TeachX Platform. The satisfaction guarantee is limited to one claim per Student.
Child Protection
16.1 TeachX seeks to provide the best service possible and provide a safe experience in which children can learn. Any User who is the parent of a child under the age of 18 who has a Lesson with a Tutor should not leave the child in the sole care of that Tutor.
User Liability
17.1 TeachX shall not be liable for any loss or damage caused by it or its employees or agents in circumstances where there is no breach of a legal duty of care owed by TeachX or by any of its employees or agents; such loss or damage was not reasonably foreseeable by both parties; or such loss or damage is caused by the User, for example by not complying with these terms and conditions.
17.2 The User will be liable for any reasonably foreseeable loss or damage TeachX suffers arising from the User's breach of these terms and conditions or misuse of the Platform.
